Health insurance claim rejected: what to do
For policyholders in India whose health insurance claim was rejected, short-paid or delayed
Get the rejection reasons in writing, then complain to the insurer's Grievance Redressal Officer, who must resolve it within 14 days. Still unresolved? Escalate to IRDAI on Bima Bharosa (155255), then the Insurance Ombudsman: free, claims up to ₹50 lakh, file within one year.
The 30-second answer
- Get the rejection in writing. For a rejection or part-payment, IRDAI's health circular says the insurer must give you full details with reference to the specific terms and conditions of the policy.
- Write to the insurer's Grievance Redressal Officer (GRO) and keep the acknowledgement. IRDAI's circular says you must get an acknowledgement immediately and a resolution within 14 days.
- Not resolved, or you disagree? Escalate to IRDAI through Bima Bharosa (or call 155255).
- Insurance Ombudsman: free, no lawyer needed. You can file once the insurer has rejected your complaint, has not replied for one month, or you are not satisfied with its reply. File within one year of that point. Claims up to ₹50 lakh.
- One catch: the Ombudsman cannot take a dispute that is pending before, or already decided by, a court, consumer forum or arbitrator. Decide the order before you file anywhere else.
Where do I complain if my health insurance claim is rejected?
Write to your insurer's Grievance Redressal Officer first and keep the acknowledgement; IRDAI's circular says it must resolve your complaint within 14 days. If it is not resolved, escalate to IRDAI on Bima Bharosa (155255). Then go to the Insurance Ombudsman, which is free, covers claims up to ₹50 lakh and must be approached within one year.

Common problems and what to do
The hospital says the cashless request was denied or delayed
IRDAI's Master Circular on Health Insurance Business (29 May 2024) says an insurer must decide on a cashless authorisation request immediately, and in any case within one hour of receiving it. The final authorisation for discharge must be given within three hours of the hospital's request, and the policyholder must not be made to wait to be discharged. If the delay goes beyond three hours, any additional amount the hospital charges is to be borne by the insurer from shareholders' funds.
What to do: ask the hospital's insurance desk for the time-stamped request and the insurer's written reply. If you pay and claim by reimbursement instead, keep every bill and say in your complaint that the cashless request was denied or delayed and when.
Rejected because a document was missing or the claim was reported late
IRDAI's Master Circular on Protection of Policyholders' Interests (5 September 2024) says: "No claim shall be rejected or closed for want of documents or for delayed intimation of claim." The health circular also says that once a claim is intimated, insurers and TPAs must collect the required documents from the hospital, and the policyholder is not required to submit them.
What to do: quote that line in your complaint, give the dates you intimated the claim and sent documents, and ask the insurer to decide on the merits.
Rejected for non-disclosure, misrepresentation or a pre-existing condition
The health circular says no health policy or claim can be contested on grounds of non-disclosure or misrepresentation, except for established fraud, after 60 months of continuous coverage (the moratorium period). Credits accrued under ported or migrated policies count towards the 60 months.
If you are inside 60 months, the insurer may still examine disclosure. Whether its reason is fair is exactly what the Ombudsman looks at, and we cannot predict the result. In your letter, state what you disclosed in the proposal form, on what date, and ask for the exact policy clause relied on.
Claim part-paid: deductions you do not understand
Under the Ombudsman Rules, a partial or total repudiation of a claim is a ground for complaint. IRDAI's health circular says that where a claim is repudiated or disallowed partially, details must be sent with full reference to the specific terms and conditions of the policy document. Ask for the clause behind each deduction (room rent, co-pay, sub-limits, non-payable items) and compare it with your policy schedule.
The claim is approved but payment is late
The Protection of Policyholders' circular says non-cashless health claims are to be settled within 15 days from submission of claim, and that if a claim is not settled within the specified timelines, the claimant is entitled to interest at bank rate plus 2 percent from the date of receipt of intimation until payment, which the insurer must pay on its own. Delay in settlement beyond the specified time is also a listed ground for an Ombudsman complaint. Mention the dates in your letter.
The insurer has not replied at all
Keep proof that you sent your written complaint (email sent item, courier receipt, portal acknowledgement). If one month passes with no reply, the Ombudsman Rules let you file with the Ombudsman. You can also register on Bima Bharosa, which sends the complaint to the insurer and the IRDAI record at the same time.
It is a group or employer policy
According to the Ombudsman FAQ, only individual policyholders, sole proprietors and micro enterprises on personal lines are eligible. A member covered under a master or group policy, or their legal heir or nominee, can approach the Ombudsman if the claim is payable to the individual as beneficiary. Companies, partnership firms, trusts and societies cannot.
What the Ombudsman cannot do
The Council for Insurance Ombudsmen FAQ says the Ombudsman cannot award ex-gratia payment, there is no provision to engage a lawyer, and no compensation above ₹50 lakh (including relevant expenses) can be awarded. There is no fee to file.
How do I complain on IRDAI Bima Bharosa?
IRDAI (Bima Bharosa) monitors insurers' compliance. IRDAI's Bima Bharosa FAQ says that if the insurer has not resolved your complaint within 2 weeks, or you are unhappy with its answer, you can approach IRDAI's Grievance Redressal Cell:
- Online: register on bimabharosa.irdai.gov.in. The complaint goes to the insurer's system and to IRDAI's records.
- Phone or email: toll-free 155255, or complaints@irdai.gov.in.
- Post: send the complaint to the IRDAI Grievance Redressal Cell in Hyderabad (address in the step-by-step ladder above).
When you register online, a Token Number is generated. Use it to track the complaint. The insurer's status updates and its final resolution show in your complainant login on the portal. If you are not satisfied with the insurer's answer, the portal says you can escalate for IRDAI to review a possible violation of regulations.
If the complaint is not attended to within 15 days of registration, or you are not satisfied with the resolution, Bima Bharosa's Our Process page says you can go to the Insurance Ombudsman. Bima Bharosa does not ask for payment of any kind. Be careful with callers, messages or look-alike sites that ask for money to speed up a claim.
Regulator step: the Insurance Ombudsman
Insurance Ombudsman is the step that can order payment. Your complaint must be in writing, signed or sent by email or the CIO website, and must state your name and address, the insurer's branch or office complained against, the facts with documents, the nature and extent of your loss, and the relief you want (rule 14). Documents the CIO FAQ lists: a copy of your complaint to the insurer, KYC particulars, a photograph for online registration, the insurer's rejection letter, the policy copy and any other relevant documents. Complaints can be made to the office whose area covers either the insurer's branch you dealt with or your residence.
You can track an online complaint at https://cioins.co.in/Complaint/Track.
